Terms and Conditions of Service and Sales Policy

General Conditions

  1. Purpose and Scope
    • 1.1. These Terms and Conditions for the Provision of Services and Sales Policy (hereinafter referred to as the “Terms and Conditions of Sale”) establish the general and specific conditions governing the sale of services made available on the website https://www.worldofdiscoveries.pt (hereinafter referred to as the “Website”), owned by World of Discoveries, S.A. (hereinafter referred to as “WOD”), with registered office at Rua de Miragaia, no. 103, parish of Cedofeita, Ildefonso, Sé, Miragaia, Vitória, municipality of Porto, district of Porto, with a share capital of €50,000.00, legal entity identification number 510 451 225, whose corporate documents are fully deposited in electronic format.
    • 1.2. You are advised to read these Terms and Conditions of Sale carefully and in full before purchasing and using the Services made available by WOD. If you do not agree, partially or fully, with these Terms and Conditions, you should not proceed with their use.
    • 1.3. For the purposes of these Terms and Conditions of Sale:
      • The expression “Customer” refers to any natural or legal person who accesses, acquires, and uses the Services of WOD.

      • The expression “Services” refers to the purchase and sale of services relating to the activities listed in Clause 3.1 of these Terms and Conditions of Sale, namely tickets for visiting the “World of Discoveries” Interactive Digital Exhibition (hereinafter “World of Discoveries”) and combined tickets, which may include tickets for two or more activities, including but not limited to:

        • cruise tickets,

        • visits to Port wine cellars,

        • access to and use of the Porto Sightseeing bus transport,

        • and/or admission to the World of Discoveries,

      according to the combinations made available on the Website.

      In addition to the general conditions, the Services are governed by specific conditions appropriate to each sector of activity, detailed below.

    • 1.4 The purchase of Services on the Website by Customers implies knowledge and acceptance of these Terms and Conditions of Sale, the Privacy Policy , and the General Terms and Conditions of Use of the WOD Website, which may be consulted through the respective links.
    • 1.5 Customers who purchase Services from WOD through travel agents or recognized tour operators shall be subject to the terms and conditions of service provision and sales policies of those entities. Accordingly, these Terms and Conditions of Sale shall not prevail, in any respect that may conflict with them, over the conditions imposed by such entities, and WOD cannot be held responsible for any matters relating to their organization, management, execution, or non-execution.
  1. Validity
    • 2.1. The WOD Terms and Conditions of Sale enter into force on the date they are published on this Website. WOD reserves the right, at any time and without prior notice, to modify or update them, as well as to suspend or terminate this Website.
    • 2.2. The Customer shall be subject to the Terms and Conditions of Sale in force on the date the Services are purchased.
  1. Sale of Services
    • 3.1. The Services marketed by WOD include:
      1. The purchase and sale of tickets for visiting the World of Discoveries.
        1. The purchase and sale of combined travel tickets, which may involve tickets for two or more activities, including but not limited to:

          • cruise tickets,

          • visits to Port wine cellars,

          • access to and use of the Porto Sightseeing bus,

          • and/or admission to the World of Discoveries,

      2. as per the combinations made available on the Website at the time of purchase.

    • 3.2. The Services are purchased at the Customer’s own account and risk, and at the time of purchase the Customer will have access on the Website to information, as well as general and specific conditions relating to their use.
    • 3.3. The ticket purchase process is carried out through a digital platform called “Ventrata”, to which the Customer will automatically be redirected in order to complete the purchase process. Although the ticketing platform is integrated into the Website, it is managed by third parties, who are therefore responsible for the execution, incorrect execution, insufficient execution, or non-execution of any payment operation.

      Its use presupposes knowledge and acceptance of the terms, conditions, and sales policy of Ventrata, and it is therefore the sole responsibility of the Customer to consult and comply with those terms, conditions, and sales policies available at: https://www.ventrata.com

    • 3.4. The Customer must proceed with payment for the Services using the payment methods made available at any given time, including but not limited to:
      • PayPal

      • Stripe (credit card, Apple Pay and Google Pay)

      • Multibanco

      • MB Way

    • 3.5. Once the purchase request has been completed, the Customer will receive an automatic email confirming the purchase and/or reservation. If the information provided is incorrect, the Customer must request correction by written communication sent to info@worldofdiscoveries.com.
    • 3.6. If the Customer does not provide personal data for invoicing purposes, the invoice will be issued to an unidentified customer.
  1. Quality and Guarantee

The presentation of any Services made available on the Website through photographs, images, videos, shapes, colors, or other representations may not correspond exactly to reality, due to, among other reasons:

  • internet connectivity limitations of the Customer,

  • use by the Customer of technological devices incompatible with the Website version,

  • natural wear and tear of physical elements resulting from regular and expected use,

  • or the existence of artistic content.

  1. Validity of Promotions
    • 5.1. Any promotion announced by WOD on its Website shall only be valid for the period expressly indicated in the information displayed and may not be applicable in the physical store.
    • 5.2. In the event of typographical errors regarding Services covered, prices, or other promotional information, WOD reserves the right to cancel any purchase made under such errors, without prejudice to the refund of the amount paid by the Customer.
    • 5.3. For the purposes of this clause, a promotion shall mean any disposal intended to encourage the sale of certain Services or the launch of a Service not previously marketed by WOD in the same commercial establishment, as well as the development of its commercial activity.
  1. Right of Withdrawal by the Customer
    • 6.1. Customers considered consumers under Decree-Law no. 24/2014 of 14 February, meaning natural persons acting for purposes that do not fall within their commercial, industrial, craft, or professional activity, may exercise their right of withdrawal under the terms provided by law and set out below, except as provided in paragraph 6.6 of this Clause.
    • 6.2. As a consumer, the Customer has the right to withdraw from the contract without giving any reason and without incurring any costs within 14 (fourteen) days from the date of purchase of the Service, unless the Service has already been used within that period.
    • 6.3. The exercise of the right of withdrawal must be made by the Customer to WOD through a written and explicit declaration, or by completing the model withdrawal form available on the Website, which must then be sent to info@worldofdiscoveries.com.
    • The Customer must attach supporting documentation to the declaration, including:

      • a copy of the invoice for the Service, and

      • an indication of the intended action: exchange or refund of the amount paid.

    • 6.4. In the case of a refund, all payments received from the Customer relating to the purchased Services will be reimbursed after receipt and verification of the condition of the same, without undue delay and in any event no later than 14 (fourteen) days from the date on which WOD received the declaration of withdrawal.
    • 6.5. Refunds will be made using the same payment method used by the Customer in the initial purchase transaction. The Customer must provide their bank account number (NIB or IBAN) to facilitate the refund process.
    • 6.6. The provisions of the preceding paragraphs do not apply to non-consumers. In such cases, Customers should consult the rules applicable to the transaction provided in the specific conditions of these Terms and Conditions of Sale relating to the Service requested.
  1. Customer Support and Complaints
    • 7.1. For any clarification, suggestion or complaint relating to the Services provided by WOD, the Customer may contact the Customer Support Service through the following email address: info@worldofdiscoveries.com.
    • 7.2. Without prejudice to the provisions of the previous paragraph, the Customer may also submit complaints through the Livro de Reclamações, available both in physical format at the facilities of World of Discoveries and in electronic format through the official platform: https://www.livroreclamacoes.pt
  1. Limitation of Liability
    • 8.1. WOD shall not be held liable for any damages or losses resulting from the use or inability to use the Website, including damages caused by viruses or any other technologically harmful material that may infect the Customer’s equipment.
    • 8.2. WOD does not guarantee that access to the Website will be uninterrupted, timely, secure or error-free.
    • 8.3. The Customer undertakes not to use the Website for illegal purposes or in a manner that may damage, disable, overburden or impair the Website or interfere with the use of the Website by other users.
  1. Intellectual and Industrial Property
    • 9.1. All elements contained on the Website, including but not limited to texts, images, graphics, logos, icons, photographs, videos, audio files, software and other materials, are protected by intellectual and industrial property rights belonging to WOD or to third parties who have authorized their use acording to the Terms and Conditions | World of Discoveries
    • 9.2. The reproduction, modification, distribution, transmission, publication or any other form of exploitation of such content, in whole or in part, without the prior written authorization of WOD or of the respective rights holders, is strictly prohibited.
  1. Privacy and Personal Data Protection
    • 10.1.The processing of personal data collected through the Website complies with:
      • The provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation, “GDPR”),

      • Decree‑Law no. 7/2004 of 7 January, as amended, and other applicable Portuguese legislation regarding the protection of personal data.

    • 10.2. Personal data collected will be processed solely for the purposes indicated at the time of collection and in accordance with the Privacy Policy | World of Discoveries available on the Website.
    • 10.3. The Customer has the rights guaranteed under GDPR and Portuguese law, including access, rectification, erasure, restriction of processing, portability, and objection, which may be exercised in accordance with the procedures indicated in the Privacy Policy | World of Discoveries.
  1. Applicable Law and Jurisdiction
    • 11.1. These Terms and Conditions shall be governed by and interpreted in accordance with Portuguese law.
    • 11.2. For the resolution of any dispute arising from the interpretation or application of these Terms and Conditions, the competent court shall be the Judicial Court of the District of Porto, with express waiver of any other jurisdiction.
  1. Alternative Dispute Resolution
    • 12.1. In the event of disputes between consumers and WOD regarding the purchase or use of Services, Customers have the right to resort to an Alternative Dispute Resolution (ADR) entity, in accordance with Decree‑Law no. 144/2015 of 8 September, which establishes the legal framework for consumer arbitration in Portugal.
    • 12.2. The competent entity for resolving disputes is the:

    • 12.3. Consumers may submit disputes through the online platform or physically at the above entity, in accordance with the procedures defined by CICAP: consumidor.pt.
  1. Liability
    • 13.1.WOD shall be held liable only for damages resulting from breaches of contractual obligations or violations of applicable law.
    • 13.2. WOD shall not be liable for indirect or consequential damages, including but not limited to loss of profits, loss of opportunity, or any other financial or material losses suffered by the Customer.
    1. Insurance

WOD complies with all insurance obligations required under Portuguese law for the activities it carries out, including coverage for visitor safety and public liability where legally required.

 

SPECIFIC CONDITIONS

This section establishes the specific conditions applicable to the Services provided and/or made available by WOD.

  1. Cancellation, Delay or Modification of Services
    • 15.1. World of Discoveries reserves the right to suspend, cancel, postpone, or modify the Services whenever there are operational reasons, emergencies, strikes, holidays, or situations of force majeure that make it impossible to provide the Services under normal conditions.
    • 15.2. In such cases, World of Discoveries will make every effort to inform Customers in a timely manner and, whenever possible, to propose suitable alternatives.
  1. Prices
    • 16.1. The prices of Services may change due to factors beyond the control of WOD, including but not limited to taxes, governmental charges, and operational costs.
    • 16.2. The price applicable to the Customer shall always be the price displayed at the moment of purchase.
  1. Reservations and Cancellation
    • 17.1. This section applies to non-consumer Customers. Customers who qualify as consumers under Decree‑Law no. 24/2014 of 14 February shall be subject to the provisions of Clause 6 of these Terms and Conditions of Sale, regarding the right of withdrawal.
    • 17.2. WOD reserves the right to freely and arbitrarily establish its opening hours, as well as to alter them without prior notice, in order to guarantee the quality of its Services.
    • 17.3. Reservations must be made directly with WOD, either at its headquarters or via email
      info@worldofdiscoveries.com for general Customers, or servico.educativo@worldofdiscoveries.com
      for school visits, including any requests for rescheduling or refund of amounts paid.
    • 17.4. Any change to the date of use of purchased tickets shall be subject to maximum capacity at WOD for the requested day, established in accordance with legal regulations and health authority requirements.
    • 17.5. Any refund requests will only be considered for review if submitted within 5 (five) days after completion of the Service.
    • 17.6. In the event of no-show on the date and time indicated on the purchased ticket, WOD reserves the right not to issue any refund or to change the date of use of the ticket.
    • 17.7. If the Customer wishes to request the correction of any of their personal data, it must be done in writing via email info@worldofdiscoveries.com.
  1. Rules for the Use of Services by Minors
    • 18.1. Without prejudice to the benefit of free admission, all minors under 3 (three) years of age must always be included in the reservation confirmation.
    • 18.2. It is expressly prohibited for a minor to remain alone in any area of World of Discoveries. The responsibility for any minor lies exclusively with the accompanying adult.
    • 18.3. For access purposes, all minors (under 18 (eighteen) years of age) must present identification and be accompanied by one of their parents or a responsible adult.
  1. Wireless Internet Access
    • 19.1. WOD provides wireless internet access. Bandwidth and coverage may be limited, and continuous access to the service cannot be guaranteed. Access by one user may be reduced to allow other Customers to use the internet. The reception staff at World of Discoveries will assist Customers to make the most of WOD’s Wi‑Fi capabilities.
    • 19.2. When using the internet via the wireless connection, Customers must use it prudently, respecting WOD rules, other Customers, and legal limits, refraining from using the connection for any illegitimate or unlawful purposes or in violation of good practices and morals.
  1. Access of Animals
    • 20.1. Companion animals are not permitted at WOD. Guide dogs and other assistance animals are allowed at no additional cost, but their presence must be coordinated at the time of reservation in order to meet WOD’s requirements for both the Customer and the animal, in accordance with applicable law.
    • 20.2. Without prejudice to the above, WOD reserves the right to refuse access to the facility or boats if an animal displays obvious signs of illness, aggression, or poor hygiene, which could compromise the safety or physical integrity of staff, Customers, or any third parties present at World of Discoveries.
  1. Alcohol and Smoking Policy
    • 21.1. The consumption of alcoholic beverages and/or smoking is strictly prohibited in all indoor areas of World of Discoveries, regardless of the type of consumption.
    • 21.2. WOD reserves the right to restrict access and/or remove any Customer from the premises without refund of the ticket price if the Customer is found consuming alcoholic beverages and/or smoking inside the facility.
