Terms and Conditions of Service and Sales Policy

GENERAL CONDITIONS

  1. Purpose and scope
    • 1.1. These Terms and Conditions of Service and Sales Policy (hereinafter referred to as “Terms and Conditions of Sale”) establish the general and specific conditions for the sale of services made available on the Website https://www.worldofdiscoveries.pt (hereinafter referred to as “Website”), owned by World of Discoveries, S. A. (hereinafter referred to as “WOD”), with registered office at Rua Miragaia, n. 103, parish of Cedofeita. A. (hereinafter WOD), with registered offices at Rua de Miragaia, n.º 103, parish of Cedofeita, Ildefonso, Sé, Miragaia, Vitória, municipality of Porto, district of Porto, with share capital of € 50,000.00, corporate taxpayer identification number 510 451 225, entity with documents fully deposited in electronic form (hereinafter “WOD”).
    • 1.2. You are advised to read these Terms and Conditions of Sale carefully and in full before purchasing and using the Services provided by WOD. If you do not agree with them, in whole or in part, you should not proceed with their use.
    • 1.3. For these Terms and Conditions of Sale, the term “Customer” shall mean the natural and/or legal person who accesses, acquires, and uses the WOD Services. The expression “Services” takes on the scope of the purchase and sale of services concerning the activities listed in clause 3.1 of these Terms and Conditions of Sale, namely tickets to visit the “World of Discoveries”, Interactive Digital Exhibition (hereinafter “World of Discoveries”), and combined tickets, which may include tickets for two or more activities, namely tickets for a cruise, visit to the Port wine cellars, access to and use of the “Porto Sightseeing” bus transport and/or visit to the World of Discoveries, according to the combination made available on the Website. In addition to the general conditions, the Services are governed by specific conditions, appropriate to each sector of activity, which are detailed below.
    • 1.4 The purchase of Services on the Website by Customers implies knowledge and acceptance of these Terms and Conditions of Sale, the Privacy Policy, as well the General Terms and Conditions of Use of the WOD Website which can be consulted via the respective links.
    • 1.5 Customers who purchase Services from WOD through recognised travel agents or travel operators will be subject to the terms and conditions of service and sales policy of said entities. Therefore, these Terms and Conditions of Sale do not override the conditions imposed by those entities in any way, and WOD cannot be held liable for any matter relating to the organisation, management and execution or non-execution of these Terms and Conditions of Sale.
  1. Validity
    • 2.1. WOD’s Terms and Conditions of Sale come into force from the date of their publication on this Website, and it reserves the right, at any time and without prior notice, to amend and update them, as well as to suspend or close this Website.
    • 2.2. The Customer shall be subject to the Terms and Conditions of Sale in force on the date of purchase of the Services.
  1. Sale of Services
    • 3.1. The Services commercialised by WOD include:
      1. Purchase and sale of “World of Discoveries” visit tickets;
      2. Purchase and sale of combined travel tickets, which may involve tickets for two or more activities, namely tickets for a cruise, a visit to the Port wine cellars, access to and use of the “Porto Sightseeing” bus transport and/or a visit to the World of Discoveries, according to the combination made available on the Website at the time of purchase.
    • 3.2. The Services are purchased at the risk of the Customer who, at the time of purchase, will have access to information, general and specific conditions relating to their use on the Website.
    • 3.3. The process of purchasing selected tickets is carried out through a digital platform called “Ventrata”, to which the Customer will be automatically redirected to carry out the process of purchasing said tickets. Although the ticketing platform is incorporated into the Website, it is managed by third parties and they are therefore responsible for the execution, incorrect execution, insufficient execution or non-execution of a payment transaction. Its use presupposes knowledge and acceptance of Ventrata’s terms, conditions and sales policy, and it is therefore the Customer’s sole responsibility to consult and comply with these terms, conditions and sales policy, available at https://www.ventrata.com/.
    • 3.4. The Customer must pay for the Services using the payment methods available at any given time, namely: paypal, stripe (credit card, apple pay and google pay), multibanco, and MB Way.
    • 3.5. Once the purchase order has been finalised, the Customer will receive an automatic email confirming their purchase and/or reservation. If the details are not correct, the Customer must change them by writing to info@worldofdiscoveries.com.
    • 3.6. If the Customer does not provide their personal details for invoicing purposes, the invoice will be issued as an undifferentiated customer.
  1. Quality and guarantee
The presentation, through photographs, images, videographies, shapes, colours, among others, of any Services made available on the Website may not correspond exactly to reality, due to, but not limited to, constraints in the Customer’s Internet connectivity, use of technological-computer devices by the Customer incompatible with the version of the Website, natural wear and tear of tangible things resulting from their regular and expected use, or the existence of content of artistic creation.
  1. Validity of promotions
    • 5.1. Any promotion that WOD announces on its Website is valid only for the period of validity that expressly results from the information displayed therein and may not be applicable in the physical shop.
    • 5.2. In the event of any clerical errors regarding the Services covered, prices or other promotional information, WOD reserves the right to freely cancel any purchase and sale made under such errors, without prejudice to the amount of the purchase being returned to the Customer.
    • 5.3. For this clause, a promotion is understood to be any sale aimed at encouraging the sale of certain Services or the launch of a Service not previously commercialized by WOD in the same commercial establishment, as well as the development of its commercial activity.
  1. The Customer’s right of withdrawal
    • 6.1. The Customer who is considered a consumer under the terms of Decree-Law no. 24/2014, of 14 February, i.e. a natural person acting for purposes that do not fall within the scope of their commercial, industrial, craft or professional activity, may exercise their right of withdrawal under the terms legally provided for and indicated below, except paragraph 6.6 of this Clause.
    • 6.2. As a consumer, the Customer has the right to terminate the contract, without having to state any reason and without incurring any costs, within 14 (fourteen) days from the day of purchase of the Service, unless the Service has already been used within that period.
    • 6.3. The right of withdrawal must be exercised by the Customer to WOD, by means of a written and express declaration or by filling in the model withdrawal form available on the Website and sent, after completion, to the email info@worldofdiscoveries.com. To this end, the Customer must send documentation to accompany the declaration, namely a copy of the invoice for the Service and an indication of the intended intention: exchange or refund of the amount paid.
    • 6.4. In the event of a return, the Customer will be refunded all payments made for the Services purchased, after receipt and verification of their condition in accordance with the above paragraph, without undue delay and, in any event, no later than 14 (fourteen) days from the date on which WOD received the declaration for cancellation of the contract entered into.
    • 6.5. The amounts paid will be reimbursed using the same means of payment used by the Customer in the initial purchase transaction. The Customer must provide their NIB or IBAN to speed up the process of returning the amounts paid.
    • 6.6. The provisions of the previous paragraphs do not apply to non-consumers. In such cases, Customers should consult the business rules set out in the specific conditions of these Terms and Conditions of Sale relating to the desired Service.
  1. Customer support and complaints
    • 7.1. For any clarification related to the Services and/or complaints, the Customer may contact the customer service department by email at info@worldofdiscoveries.com.
    • 7.2. The Customer may also submit a complaint via Livro de Reclamações, in online or physical format, made available for this purpose by WOD
  1. Disclaimer of liability
    • 8.1. WOD accepts no liability for any direct or indirect damage that may occur as a result of using this website or any other linked website. Likewise, it does not guarantee that access to said sites will be uninterrupted or free of errors, viruses, or other harmful content, and is not subject to any liability arising from claims for these facts.
    • 8.2. The Customer undertakes not to use any content on this site that is offensive, unlawful, or contrary to the law, nor to enter false, vitiated or misleading data, and shall be liable for any conduct in breach of this obligation. Should any of these circumstances arise, WOD will cooperate fully with the competent law enforcement authorities.
  1. Intellectual and industrial property
    • 9.1. The brands, names, and other elements displayed on the Website are protected under the terms of the legal provisions applicable to intellectual and industrial property and by the General Terms and Conditions of Use of the Website.
    • 9.2. The use, reproduction, or representation, in whole or in part, of these elements is strictly and expressly prohibited and must be authorized in writing in advance by WOD or the respective owners.
    1. Privacy
The processing of personal data carried out by WOD complies with the Community and national legislation currently in force, namely Regulation (EU) no. 679/2016, of 27 April (General Data Protection Regulation of the European Union) and Law no. 58/2019, of 08 August (Personal Data Protection Law). For additional information, the Privacy Policy is available on this website, which we recommend you read carefully and in full.
  1. Interpretation, applicable law and jurisdiction
    • 11.1. These Terms and Conditions of Sale are drawn up and interpreted in the light of Portuguese law.
    • 11.2. If any provision of these Terms and Conditions of Sale is declared null and void, ineffective or voidable, this shall not affect the validity or effectiveness of the remaining provisions, which shall remain in full force and effect.
    • 11.3. In the event of a dispute, the competent court shall be the Judicial Court of the District of Oporto, expressly waiving any other, without prejudice to the application of mandatory rules.
  1. Arbitragem
    • 12.1. Under the terms of Law no. 144/2015, of 08 September, the Customer may submit a complaint to the following dispute resolution body: Centro de Informação de Consumo e Arbitragem do Porto: cicap.pt.
    • 12.2. WOD declares that it has not joined any of the dispute resolution organizations and is therefore not bound to accept that the resolution of any dispute be submitted to any alternative means of dispute resolution.
    • 12.3. For further information, the Customer should consult the Consumer Portal: consumidor.pt.
  1. Liability
    • 13.1. WOD shall only be liable for damages suffered by the Client if such damages result from breaches attributable to its contractual obligations towards the Client or arising from applicable legislation.
    • 13.2. WOD shall not be held liable for damages suffered by third parties and/or the Client resulting from the Client’s misuse of the Services through negligence or wilful misconduct.
    1. Insurance

WOD fully complies with the insurance requirements of Portuguese law.

SPECIFIC CONDITIONS

This section sets out the specific conditions applicable to the Services provided and/or made available by WOD.

  1. Cancellation, delay, or modification of the Services
    • 15.1. WOD reserves the right to freely and arbitrarily suspend, cancel, postpone, or alter the Services for any reason whatsoever, including, by way of example, mechanical problems, medical emergencies, strikes or work stoppages on site, local holidays, and other reasons of force majeure, among others, without any obligation to compensate the Customer arising from this.
    • 15.2. Force majeure refers, among other things, to the occurrence of external, unforeseeable events beyond WOD’s control, namely of a political-social nature (war, riots, pandemics, epidemics, among others) or of a natural nature (earthquakes, floods, fires, among others).
  1. Prices
    • 16.1. The prices of the Services may be altered as long as the conditions justify it, namely due to unforeseen increases in government charges, taxes, or surcharges, as well as changes in any external costs beyond WOD’s control.
    • 16.1. The prices of the Services presented to the Customer include value-added tax (VAT) at the legal rate in force at the time of purchase. Minors up to the age of 3 (three) do not pay. The rules governing the use of the Services by minors can be found below and should be consulted by the Customer.
  1. Bookings and cancellations
    • 17.1. This section applies to non-consumer Customers. The provisions of Clause 6 of these Terms and Conditions of Sale, regarding the right of withdrawal, shall apply to Customers who assume the status of consumers under Decree-Law no. 24/2014, of 14 February.
    • 17.2. WOD reserves the right to freely and arbitrarily establish opening hours and to change them without prior notice in order to guarantee the quality of its Services.
    • 17.3. Bookings must be made directly with WOD, at its head office or via email info@worldofdiscoveries.com in the case of Clients, or servico.educativo@worldofdiscoveries.com in the case of school visits, as well as any requests for rescheduling or refunds.
    • 17.4. Any change to the date of use of the tickets purchased will be subject to the maximum capacity of the WOD for the day desired by the Client, defined in accordance with the safety rules imposed by law and the health authorities.
    • 17.5. Any refund requests will only be considered for analysis if they are submitted within 5 (five) days of the end of the Service.
    • 17.6. In the event of a no-show on the day and time stipulated in the ticket purchased, WOD reserves the right not to make any kind of refund and/or change the date of use of said ticket.
    • 17.7. If the Customer wishes to request the correction of any of their personal details, they must do so in writing to info@worldofdiscoveries.com.
  1. Rules governing the use of the Services by minors
    • 18.1. Without prejudice to the free-of-charge benefit, all minors under the age of 3 (three) must always be listed on the booking confirmation.
    • 18.2. It is expressly forbidden for minors to be left alone in any area of the World of Discoveries. The responsibility of any minor is the sole responsibility of the accompanying adult.
    • 18.3. For access purposes, all minors (under 18 years of age) must present an identification document and must be accompanied by a parent or responsible adult.
  1. Wireless internet connection
    • 19.1. The WOD has a wireless internet connection. The bandwidth of the connection and the coverage area may be limited, so continuous access to this service cannot be guaranteed. One person’s usage may be reduced to allow more Customers to access the Internet. World of Discoveries receptionists will help Customers take full advantage of WOD’s Wi-Fi capabilities.
    • 19.2. When using the Internet via a wireless connection, Customers must use it prudently, with respect for WOD’s rules of conduct, for other Customers and within the limits permitted by law, refraining from using the connection for any illegitimate purpose contrary to the law and good customs.
  1. Animal access
    • 20.1. Pets are not allowed in WOD. Guide dogs and other animals for personal support are authorized at no additional cost. They must be specifically coordinated at the time of booking to meet and fulfill the needs of the Client’s WOD and their animal, under the terms of the legislation in force.
    • 20.2. 20.2. Without prejudice to the above, WOD reserves the right to refuse the animal access to the vessel if it shows obvious signs of illness, aggression or lack of hygiene, which could jeopardize the safety and physical integrity of employees, Clients or any third parties present at World of Discoveries.
    1. Alcoholic drinks and smoking policy
It is expressly forbidden to consume alcoholic beverages and/or smoke in any of the areas inside the World of Discoveries, regardless of the type of consumption. WOD reserves the right to restrict the access and/or stay of any Customer, without reimbursement of the ticket price, if they are found to be consuming alcoholic beverages and/or smoking inside the World of Discoveries.
